Job Overview:
We are seeking an experienced Paralegal with a background in employment law and a deep understanding of arbitration processes under AAA, ADR, FAA, and Minnesota employment law. The candidate will assist with an ongoing employment arbitration case, which is currently in the discovery and motions phase, and help navigate the remaining stages of the arbitration, including finalizing discovery, addressing compliance issues, and preparing for upcoming mediation and hearings.
Key Responsibilities:
• Discovery Management: Review and organize outstanding discovery materials. Assist with identifying missing items and documenting issues with portal access, deleted files, and non-compliance by opposing counsel. Ensure all necessary documents are retrieved or motions are filed to exclude unavailable discovery.
• Motion Preparation: Draft and file motions relating to:
• Exclusion of evidence based on non-compliance by opposing counsel.
• Pro se abuse by opposing counsel (e.g., rehashing settled issues, overburdening with redundant requests).
• Non-compliance with discovery deadlines and other arbitration agreement requirements.
• Extension requests for both the exhibit list and discovery deadlines (two-month extension preferred) to allow proper review of all materials.
• Communication Management: Handle legal correspondence with opposing counsel, documenting all attempts to meet and confer on unresolved discovery matters, lack of responses, and failure to address settlement offers.
• Mediation and Arbitration Preparation: Assist with preparing for mediation scheduled for October 30, 2024, including organizing evidence, correspondence, and drafting response letters. Ensure the exhibit list is complete, noting the delays caused by incomplete discovery from opposing counsel.
• Legal Research & Statutory Application: Research and apply relevant federal and state employment laws, including AAA rules, FAA provisions, and Minnesota-specific statutes, to strengthen motions and responses. Ensure compliance with legal requirements and deadlines in arbitration.
• Documentation & Evidence Review: Support the creation of a clear timeline of events and document exchanges, including tracking discovery provided, deleted, and re-requested. Assist with compiling email evidence of opposing counsel’s agreement to mediation terms and their failure to respond to key legal correspondences.
Requirements:
• Demonstrated experience as a paralegal in employment law and arbitration proceedings under AAA, ADR, and FAA rules.
• Knowledge of Minnesota employment laws and arbitration procedures.
• Proven track record of managing complex discovery processes, including issues with compliance and document production.
• Ability to draft high-quality legal motions, especially concerning pro se abuse, non-compliance, and arbitration issues.
• Strong communication skills, especially when working with pro se parties and preparing legal responses to opposing counsel.
• Excellent organizational skills and attention to detail, with the ability to manage multiple deadlines and maintain accurate legal documentation.
• Proficiency in legal research and drafting detailed motions that reference applicable laws and arbitration requirements.
Preferred Qualifications:
• Paralegal certification or relevant legal education.
• Experience working on employment arbitration cases, particularly those involving pro se parties.
• Knowledge of the AAA and FAA regulations, and Minnesota employment law statutes.
• Experience working on discovery motions, especially regarding exclusion requests and compliance enforcement.
